Legionnaires' disease. It's a phrase that rattles even the most stalwart facility professional. From bad press to disruptive emergency disinfection processes to diminished property values to claims and lawsuits, this microscopic bacteria has the potential to cause enormous trouble.

According to an August 2011 Centers for Disease Control and Prevention report, Legionnaires' disease is on the rise, increasing by 217 percent in the last decade - or 18,000 to 20,000 cases annually in the United States.

This summer, the American Society of Heating, Refrigerating and Air-Conditioning Engineers, Inc. is scheduled to release ASHRAE Standard 188: Prevention of Legionellosis Associated with Building Water Systems – a new standard requiring that facility owners and managers implement stronger safeguards via proactive risk assessment and risk management practices aimed at preventing Legionellosis from being contracted in commercial, institutional and industrial buildings.

    • Garry Boehlert focuses his practice on resolving claims and disputes arising on the type of complex projects our members own and manage. He regularly assists owners, contractors, specialty subcontractors, engineering/design firms and property managers with the negotiation and litigation of claims. He specializes in defending Legionellosis lawsuits.

      Mr. Boehlert was recently successful in gaining dismissal of a multi-million dollar wrongful death Legionnaires’ disease case in the trial court by summary judgment. The dismissal was affirmed based on the arguments he presented to the Fourth Circuit Court of Appeals. He is familiar with the science, medicine and legal issues involved in Legionnaires’ disease cases. As a result of his work in this area he has strong working relationships with many of the best laboratory, water treatment and medical experts in the industry.

      Mr. Boehlert has litigated cases in the federal and state trial and appellate courts in more than 20 states and in several international forums. He is familiar with creating and participating in various forms of alternative dispute resolution and has successfully conducted numerous mediations and arbitrations. Prior to entering law, Mr. Boehlert worked on significant infrastructure projects such as the Trans-Alaska Pipeline and bridge construction on an interstate highway. In short, he knows his way around a project and speaks your language when it comes to resolving disputed issues.

Janet Stout, PhD

    • Dr. Janet E. Stout is the Director of the Special Pathogens Laboratory, and an Associate Research Professor at the University of Pittsburgh Swanson School of Engineering in the Department of Civil and Environmental Engineering,

      A clinical and environmental microbiologist, Dr. Stout is internationally recognized for her more than 30 years of authoritative research in Legionella-the bacteria the causes Legionnaires’ Disease. Her expertise includes disinfection and control strategies for the prevention of Legionnaires’ disease and other waterborne pathogens.

      In 1983, Dr. Stout first demonstrated the link between the presence of Legionella bacteria in hospital water systems and the occurrence of hospital-acquired Legionnaires' disease. Her results were published in the New England Journal of Medicine. In addition, Dr. Stout was instrumental in developing the prevention strategy for hospital-acquired Legionnaires’ disease, which now serves as the model for national guidelines.

      Dr. Stout's research Legionnaires' disease in water systems of homes, buildings, hospitals, hotels and utility water systems has been published in medical and scientific peer-reviewed journals. She co-authors the "Legionella" chapter published in Hospital Epidemiology and Infection Control and the Manual of Clinical Microbiology. Currently, on the editorial board of Infection Control and Hospital Epidemiology, Dr. Stout has also served on editorial boards of the International Journal of Environmental Health, the Journal of Clinical Microbiology, and Water Research.

      An invited speaker to international and national scientific and professional organizations, Dr. Stout is a member of the American Society for Microbiology, the Association for Professionals in Infection Control, the Cooling Technology Institute, and the America Society of Heating, Refrigerating and Air-conditioning Engineers (ASHRAE), in which she is a member of the ASHRAE Legionella Standards committee.

      Dr. Stout holds a master's degree and PhD in infectious disease microbiology from the University of Pittsburgh, and a BS in biology from Clarion University.
